Personal Property Securities Reform Update.

Please be advised that the Attorney General’s Department has indicated that there will be a delay with regards to the commencement time of this legislation. Under current legislation, the commencement time was to be implemented by no later than 1 February 2012, however it would appear that the Department is not yet satisfied with the User Acceptance Testing of the Personal Property Securities Register before it goes live, and more trials are required.

As a result, a Bill was introduced to Parliament on 12 October to remove the legislated deadline of 1 February 2012, and give the Attorney General the power to extend the commencement time past this date, if necessary.

At this stage there is no definitive time as to when the Register will be ready and the Department has indicated that the commencement time will take place in “early 2012”. Naturally this delay will cause some frustration to businesses particularly given that there is no clear commencement date.

It is important to stress the legislation has passed and this delay is merely a technical glitch. We recommend that businesses should use the delay to their advantage, particularly if they have not yet got their affairs in order.
